Welcome to Fight Fit VR! This privacy policy outlines how we collect, use, and protect user data in our game. By playing Fight Fit VR, you agree to the terms described below.  Note this privacy policy applies to Fight Fit VR and its demo Fight Fit VR Demo.  All references to Fight Fit VR also apply to Fight Fit VR Demo

1.1. This Privacy Policy describes the Fight Fit VR team’s ("we", "our") practices for handling your personal information when you play Fight Fit VR.

2. What will I find in this document?

2.1. Below you will learn why, to what extent, for what purpose and for how long we process your personal data. You will also learn who will have access to your personal data and what your rights are in relation to the processing of the personal data.

 

2.2. We respect your right to privacy and, despite the fact that we try to process as much information as possible as anonymised or pseudonymised data and as little as possible and retain the data within Meta Quest Developer Center website only.

3. What kind of personal data about me are you collecting and why?

3.1. So that you can play Fight Fit VR and we are able to repair and improve the game, we collect the following data about you: identification data (avatar, nickname or user ID under which you are registered, etc.); technical data (data about your device, etc.); data concerning your use of Fight Fit VR (when, how and how successfully you play the game).

 

We only use these personal data for the two below-specified purposes: to enable the functioning of Fight Fit VR and to create statistics contributing to the improvement of the game.

 

3.2. Firstly, we need your personal data described above (identification data, technical data and game use data) so that the game is functional, including leaderboards, etc. The reason for such processing is based on the necessity to fulfil the agreement between you and us. For people in the EU under the age of majority (under 18 years in most EU countries) who have a limited ability to enter into an enforceable contract, the reason for such processing is based on our legitimate interests.

 

3.3. We need to process some of your personal data for statistical purposes. These include either purely technical data (i.e. information not containing any personal data at all) or the other above-described data in pseudonymised form, that is, highly confidential data to which we assign a special number so that nobody except for us is able to match the data to the existing identifier using the given number. This processing is based on our legitimate interest, which is the continuous improvement of the game. You have the right to object to this processing in the manner described below.

4. How will you process my personal data?

4.1. With regard to the above-mentioned purposes, it is apparent that we do not need your personal data in a form that enables your identification. For this reason, we shall process the information (especially statistics) in aggregated (non-identifiable) form as much as possible, and where this is not possible, we shall process the information in pseudonymised form as much as possible.

5. Do you need my consent for the processing?

5.1. In fact, we do not need your consent as for all forms of processing, we have other legitimate reasons (because this is necessary for fulfilment of agreement or it is in our legitimate interest).​

6. How long will you retain my personal data?

6.1. We will keep your personal data for as long as it is necessary to fulfil the purposes for which it was collected as described above and in accordance with applicable law.

Only for the time for which you play Fight Fit VR and at the maximum until you've deleted your account on any platform that you used to purchase our game or until you've ensured the complete erasure of Fight Fit VR from your library on any given platform. However, most of the data is kept in aggregate form only (when you cannot be identified) and only for as long as necessary.

7. Do I have to give my personal data to you? Do you have to process it?

7.1. If you want to play Fight Fit VR, we need the said personal data as per paragraph 3 above so that we can enable you to play. Unfortunately, this is not possible without your personal data.

8. To whom do you transfer my personal data?

8.1. We have the personal data in our possession for the whole time on the Meta Quest Developer Center website.  We do not share this with other parties with the exception of the below.

 

8.2. Apart from us, however, your personal data are also processed by the platforms through which you have purchased our game and, in those circumstances, your personal data will be processed in accordance with the relevant platform's privacy notice:

What rights do I have?

9.1. With regard to the fact that we process information concerning you, you may assert certain rights, about which we want to inform you in this section. You may assert all of the rights in writing to fightfitvr@gmail.com

 

Right to access

9.2. You have the right to access the processed personal data concerning you.

 

Right to rectification

9.3. We only need to process your accurate personal data. You may have the right to the rectification of your personal data that is inaccurate or incomplete.

 

Right to erasure

9.4. You have the right to request that we erase your personal data at any time for any reason and irrespective of jurisdiction but please note you may no longer be able to play Fight Fit VR due to the game’s use of Meta Quest’s leaderboard functionality.

 

Right to data portability

9.7. Another right that you may assert is the right to data portability based on which we will hand over the personal data provided by you in a commonly used, structured and machine-readable format or, if you require, we will transfer them to another controller of your own choice, where such transfer is technically feasible.

 

9.8. If you believe that your personal data processed by us is incorrect, you may have the right to demand that we restrict the processing of your personal data for a period necessary to verify the accuracy of your personal data and to rectify it if needed. You also have this right if the processing of your personal data is illegal, but you do not wish for your personal data to be erased; if we no longer need your personal data for the above-specified processing purposes, but you demand that your personal data are preserved for the purposes of the determination, exercise or defence of your legal claims; or if you have objected to the processing of your personal data on the basis of our legitimate interest.

 

Right to object to processing on the basis of legitimate interest

9.9. With regard to the fact that we process some of your personal data on the basis of our legitimate interest, you may have the right to object to this processing. Based on the objection, we will consider whether it is really in our interest to process your personal data for the given purpose. If we conclude that we do not have any significant legitimate reasons that prevail over your interests, rights or freedoms, we will terminate the processing of and destroy such personal data.

9.10. However, it needs to be stressed that such objection should be well-founded. Therefore, we recommend that you firstly obtain all of the necessary information at the above-mentioned email address.

 

Right to complain

9.11. To make a complaint about our handling of your information, please write to us at fightfitvr@gmail.com. You may also raise the matter with your local data protection regulator

We restrict our data collection to the data provided to us by Meta.  Primarily this is to provide Meta Quest leaderboard functionality to Fight Fit VR’s players so they can see their rank, the top ten scores and the top ten scores of the player’s friends.  For this functionality we utilize the player’s user name, score and rank only.

 

This data is retained by us in the meta quest developer center website only for as long Meta provides the data or till the user requests the data to be deleted.  The data is visible to the user and other users in the meta quest leaderboard so long as Meta displays/provides the leaderboard data and / or the user has requested their data to be deleted. 

 

The data is processed as follows:  at the end of each game session, the code submits the players score to the Meta Quest Leaderboard API and then returns from the same API the rank for that score, the top ten score across all users and the top ten for the user's friends.  This data is displayed in game and separately in Meta's leaderboard functionality and separately to the developer in the Meta develop website.  There is no further processing of the data beyond this except to delete an entry at the user's request, if they were to request it. 

 

Note all users can request their data be deleted at any time for any reason without restriction and at no charge or fee and irrespective of region or any other characteristic but please note it may take up to 5 business days for the request to be processed.  If you wish your data to be deleted, please submit the request to fightfitvr@gmail.com.  Please include the username you want the data deleted for as without this, the leaderboard data you want deleted cannot be deleted. 

 

The purpose for collecting the leaderboard data is to provide a fun and motivational tool to encouraging players to improve their score and see how well they have performed in comparison to others, both those they don't know and those they do, their friends.
